Terms of Service

Session fees are due at the time of booking and are also non-refundable.

No part of any order, including digital previews, will be delivered until the balance is paid in full and on the understanding that the product which you have ordered is non-refundable.

In the event of illness or hospitalisation, please call or email as soon as you are able to to reschedule your appointment.

Sgùrr Photography or Trading Names under the Sgùrr Photography Umbrella maintains the right to reschedule if required due to inclement weather, illness, emergency which are out of our control.

Requests for rescheduling your appointment/s are granted only at the photographer's discretion.

The decision to reschedule must be made before the appointment with a minimum time of 48 hours notice will need to be given.

Editing timescales could take between 3 to 4 weeks during busy periods with final orders for wall art and other products may take between two and three weeks depending on our suppliers turnaround at the time of placing the order. Where possible we will get your order to you sooner than the stated timescales above however orders from external suppliers can often take the full times stated above.

Sgùrr Photography or trading names under the Sgùrr Photography Umbrella retains the copyright on all images (even those purchased digitally) Sgùrr Photography or trading names under the Sgùrr Photography Umbrella also reserve the right to use the images for social media advertising, any form of advertising, public displays, publication, or any other purposes. The client signing this contract warrants that he or she has actual authority to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the photographer in the event of litigation arising out of such use. RAW files will not be supplied to the client only high resolution JPG file types, Sgùrr Photography will never release the RAW file to the client.

Digital files and previews remain the exclusive property of the photographer. Under no circumstances, can a client use these images for profit, commercial endeavours or website/blog as it is considered theft regardless of the intent to which you have used them.

NOTICE OF COPYRIGHT: It is ILLEGAL to redistribute the photographs taken by Sgùrr Photography or trading names under the Sgùrr Photography Umbrella for profit or use them in anyway other than for private use without Sgùrr Photography’s permission, such people who violate this Copyright Law of the UK Copyright Law will be subject to its civil and criminal penalties.

Please note that you the ‘client/s’ agree and are also aware that the quality of the final print/s taken from digital files chosen by you are printed by suppliers out with the company and is not within the control of Sgùrr Photography or the photographer, which in turn frees Sgùrr Photography or the photographer working for Sgùrr Photography from any liability for any claims whatsoever based upon any quality issues, defects after print or any other issues regarding quality of the finished product in the end result print. The photographer is not responsible for any printing errors which may occur or for quality of the prints or products printed, or any workmanship of frames and wall art.

If Sgùrr Photography cannot fulfil this Contract due to fire, accident, bereavement, strike, act of god, or other cause beyond the control of the parties, or due to an illness of the photographer or an emergency then Sgùrr Photography shall return any deposit or fee to the client but shall have no further liability in respect of the contract.

This limitation on liability shall also apply in the event that prints, wall arts or any other purchased products are damaged whilst in transit or other, lost camera or media malfunction, lost in the mail or otherwise lost or damaged without fault of Sgùrr Photography.

In the event Sgùrr Photography fails to perform for any other reasons than listed above, Sgùrr Photography shall not be liable for any amount in excess of the retail value of the client's order. The client releases Sgùrr Photography or Trading Names Under the Sgùrr Photography Umbrella from all liabilities, claims and or damages that may result in accidents or incidents that may happen during the session.

The charges in the contract are based on Sgùrr Photography or Trading Names Under the Sgùrr Photography Umbrella standard price list. This price list can at any time be adjusted without notice to past present or future clients periodically and future orders shall be charged at the prices in effect at the time the order is placed.

Copyright - All images are copyright under the UK Copyright Laws and subject to fines if by signing this contract you are agreeing not to use any of the images without watermarks in any social media (Facebook, Twitter, Instagram etc) Watermark-free images are for personal use of the client only, Watermarked images will be issued with digital orders for this purpose.

The Copyright, Designs and Patents Act 1988 (c. 48), also known as the CDPA, is an Act of the Parliament of the United Kingdom which received Royal Assent on 15 November 1988. It reformulates almost completely the statutory basis of copyright law (including performing rights) in the United Kingdom, It also creates an unregistered design right, and contains a number of modifications to the law of the United Kingdom on Registered Designs and patents.

Essentially, the 1988 Act and amendment establishes that copyright in most works lasts until 70 years after the death of the creator if known, otherwise 70 years after the work was created or published (fifty years for computer-generated works).
